A Chapter 7 bankruptcy provides a way for individuals or businesses to have a fresh start in life, and who do not have the financial means to repair their debt situation.  This is a no-asset case and individuals keep most, if not all of their property, including homes, vehicles and retirement accounts.  A Chapter 7 bankruptcy is used to discharge debts such as credit card bills, medical bills, personal loans, payday loans, utility bills and even some types of taxes.

A Chapter 13 bankruptcy exists for individuals who usually have fallen behind on their mortgage and allows the individual to enter into a payment plan in order to pay off the arrearages on their mortgage.  If a modification has not worked out for you, a Chapter 13 bankruptcy is another option. It also exists for individuals who have too much equity in their residence.  A Chapter 13 plan establishes a payment plan for individuals to pay back their creditors up to but not exceeding a period of sixty months.  This payment amount is determined by income and other factors.
